Myriad Genetics, Inc., ha annunciato il 15 maggio di aver ottenuto alcuni brevetti sulla scoperta dei cromosoma legati ai geni BRCA1 e BRCA2 (che determinano il cancro al seno e alle ovaie), e il diritto in esclusiva per lo  sviluppo di prodotti medicinali da usare a fini terapeutici e diagnostici.

L' Ufficio dei brevetti europeo (European Patent Organization - EPO) ha concesso alla Myriad il brevetto numero 0699754: Method for Diagnosing a Predisposition for Breast and Ovarian Cancer, using the BRCA1 and BRCA2 genes.

LA DICHIARAZIONE DI "INVENZIONE" DEL GENE BRG1

The present invention relates to the relation of the BRG1 gene (also called SNF2 alpha) to human cancers and its use in the diagnosis and prognosis of human cancer. The invention also relates to the therapy of human cancers which have a mutation in the BRG1 gene, including gene therapy, protein replacement therapy and protein mimetics. MYRIAD GENETICS AWARDED THREE U.S. PATENTS AND EIGHT INTERNATIONAL PATENTS

Patents Issued in Europe, Canada, Australia and New Zealand Encourage Broad Availability of Predictive Medicine

Myriad Genetics, Inc. (Nasdaq: MYGN) announced today that it has received eight foreign patents covering the BRCA1 and BRCA2 breast and ovarian cancer genes and their use in the development of therapeutic and predictive medicine products. The European Patent Organization awarded Myriad patent number 0699754 for a "Method for Diagnosing a Predisposition for Breast and Ovarian Cancer", using the BRCA1 and BRCA2 genes. Four Canadian patents, numbers 2,196,790, 2,196,795, 2,196,797 and 2,239,733 have been awarded to Myriad, as have two Australian patents, numbered 686004 and 691958, and New Zealand patent number 326525, covering the BRCA genes.

"International patents provide important protection for us and our marketing partners as we expand the availability of our predictive medicine products globally," said Peter Meldrum, President and Chief Executive Officer of Myriad Genetics, Inc. "The intellectual property estate surrounding our breast cancer predisposition test, BRACAnalysis®, is firmly established in the United States with nine issued patents, and now extends internationally with eight issued patents. Myriad is currently marketing BRACAnalysis® in Canada and Japan and we expect to expand to all major world markets in the future."

Following an intensive period of development four years ago, by a dedicated resourceful team, Myriad introduced BRACAnalysis®, an extremely accurate and rapid method to determine a woman's risk of hereditary breast and ovarian cancers. The predictive medicine test is reimbursed by most insurance companies and HMOs and has become the standard of care for patients with a family history of breast or ovarian cancer. Medical societies endorsing breast cancer predisposition testing include the American Society of Clinical Oncologists, the American College of Medical Genetics, the Society for Surgical Oncology, the American College of Obstetricians and Gynecologists and the National Comprehensive Cancer Network. BRACAnalysis® contributed significantly to 103% revenue growth of the Company's predictive medicine products business in the most recent fiscal quarter, compared with the same quarter in the prior year. 

In other patent news, the Company was awarded patent number 6,225,451 by the United States Patent and Trademark Office for the CHD1 gene, a heart disease gene involved in lipid metabolism. Myriad licensed the CHD1 gene to Novartis for therapeutic development, and Myriad is investigating the gene as a potential future predictive medicine product. Myriad also received two new patents, numbered 6,180,776 and 6,210,949 on the MTS2 (p19) tumor suppressor gene.
